Saudi Arabia prevents divorce without a judicial decree

Prospective changes to the Saudi Personal Status Act placed “abusive people” to the test after the declaration by the Minister of Justice, Walid Al-Samaani, that those wishing to divorce could not satisfy their wishes without the attendance of their wives before the courts.

This is a new victory for women in the multiple winning packages authorized by the Ministry of Justice in the last century. The definition of “violence” in its verbal sense refers to these men, when they illegally exercise the right to hurt others, in such a way that the houses are full of divorcees, for purposes and justifications that do not amount to the destruction of this sacred entity.

With the advent of smart technology that avoid the use of words to take a divorce oath, the judiciary has reported more than one case of separation by text messages. Interestingly, the same process that some take as a “divorce vow” is listed as one of the triggers that contributed to the sad ends of life’s partners.

Until recently, it was very simple for man to take “historic” decision electronically by filling out the case sheet form and set an appointment through the referrals and appointments department in the court, then attend in person in the absence of the original party in the case, the “wife”.

 This matter was resolved by Minister Al-Samaani by obligating him to appear shoulder to shoulder with the divorced woman, and placing the one who desires to divorce in a field confrontation with the divorced, so that the judge may make his decision after hearing the parties to the dispute.

according to one of the Mufti of the Internet, divorce takes place faster if a person pronounces it or writes it in a piece of paper or in a phone message as soon as he planned to do so, and in September 2013 the City Court ordered the divorce of a woman through WhatsApp after the husband sent her a message Confirmed with “You are divorced” three times.

The wife addressed the court with her husband’s letter, who attended and admitted that the letter had been sent from his phone, stating that the message had been sent by accident, and that it was not meant to bring an end to the marital partnership, but the judge found it to be a permanent divorce, and the wife received a divorce document accordingly.

Statistics indicate that the divorce certificates issued by Saudi courts in the past in Shaban exceeded the number of marriage contracts in Makkah, Riyadh, Eastern Province, Qassim, Hail, and Najran. The number of divorce certificates reached 4,566, about half of which were given in the Makkah and Riyadh regions.

This condition will not proceed as it was after the changes to the Personal Status Act have been introduced by the Ministry of Justice. Men are faced with their historical duty to make self-determination decisions without, slurs, arbitrariness or obstinacy!
